Sea Aggie Researchers Make Evening Fun with Science on the Beach

“The environment is where we all meet; where we all have a mutual interest; it’s the one thing all of us share.” – Lady Bird JohnsonOn Galveston Island, beaches rank among the favorite environments to share and study, and, as Texas A&M University at Galveston faculty emphasized last week, are “More Than Just Sand.”A program subtitled “The Secret Life & Value of Sandy Beaches” drew more than 40 people to the Aug. 13 meeting of Surfrider Foundation Galveston, a local chapter of a nonprofit focused on the protection and enjoyment of oceans and beaches. The evening began barefoot with ecology lessons on the sand before moving across Seawall Boulevard for beverages, bites, and more beach talk at an area establishment. Drs. Guilherme Corte and Yasmina Shah Esmaeili show how a mesh bag is used as a sieve to separate organisms from samples of the sand. Credit: TAMUG Divisions of Marketing and CommunicationsNot far from where others were enjoying the attractions at Pleasure Pier, Drs. Guilherme Corte and Yasmina Shah Esmaeili introduced the ecologically curious to species living within the sediments.“When people hear ‘coral reefs,’ they immediately think of fish, live ecosystems, but when they think of sandy beaches, they think party, recreation, vacations – not coastal ecosystems,” said Corte, an assistant professor of marine biology in the College of Marine Sciences and Maritime Studies at TAMUG.Shah Esmaeili co-founded the Gulf eDNA Network and works with Corte in TAMUG’s Benthic Ecology Lab.“Sandy beaches are indeed great places for leisure and recreation,” Corte said. “Let’s keep enjoying them, because they are awesome. But they are also full of life that we most of the time don’t realize is there.”The married couple soon had the beachcombers measuring the slope with PVC poles, searching for ghost shrimp with a stainless-steel pump, sifting for marine worms and sand fleas, and guessing which species would burrow fastest back into the sand once released.Away from the sand, the focus turned to research from Drs. Ashley Ross ’03, ’10, and Virgie Greb, ’25 and those words from Lady Bird Johnson reminding people that the environment isn’t separate from their daily lives.“It’s about things that we value, mostly our communities, strong local economies, outdoor recreation, cultural connections, and our overall quality of life,” said Greb, a proud BOI – born on the island – Galvestonian, who now works in Austin as a project manager for the Texas General Land Office. “Along our coast, these benefits are deeply interconnected.”Greb and Ross, an associate professor in marine and coastal environmental science with the College of Marine Sciences & Maritime Studies, have studied a variety of ways beaches and the sea are important to Galveston and those who live there. Drs. Ashley Ross (left) and Virgie Greb (standing at right) field questions after their presentation. Credit: TAMUG Division of Marketing and CommunicationsIn 2023, using three survey methods – online for Galveston County residents, in-person at beaches, and paper distributed via city water bills – they collected 732 complete responses, 53 percent from residents and 47 percent from visitors. Most were frequent beachgoers who gave the recreation value of Galveston beaches a “B” and rated amenities such as restaurants, lodging, shopping, and beach access highly. Lower rated were water clarity and restroom facilities.“It’s noticeable that primary residents actually rate water quality higher; they’re more tolerant of hard, turbid water,” Ross said, crediting them with better understanding the natural conditions with the Trinity and San Jacinto Rivers bringing sediments and rich nutrients to the area around Galveston.Island residents also were more likely to understand that “clear” isn’t the same as clean beach water and to know that water quality is regularly tested. Clean means absent of disease-causing pathogens.“We need more education and outreach focused on water quality and the benefits of Galveston beaches and shores and water,” Greb said. “And it’s not just for tourism. There are a lot of people who are very lucky to live on an island with beaches and the bay.”

Immune cells flood into the aging brain, Stanford scientists discover

Scientists have discovered that the aging human brain may be far less isolated from the rest of the body than once believed. Stanford researchers found that large numbers of immune cells from the blood begin entering the brain as early as middle age, where they can transform into microglia, the brain’s specialized immune cells. The finding overturns a long-standing assumption that these cells remain largely separate from the body’s immune system throughout life.

Ernst Names Small Business of the Week, Lone Arranger

Read the release on Sen. Ernst's website HERE. Throughout this Congress, Chair Ernst plans to recognize a small business in every one of Iowa’s 99 counties. RED OAK, Iowa – U.S. Senator Joni Ernst (R-Iowa), Chair of the Senate Small Business Committee, today announced her Small Business of the Week: Lone Arranger of Adams County. Throughout the 119th Congress, Chair Ernst plans to recognize a small business in each of Iowa's 99 counties. "Lone Arranger has been in full bloom in Adams County for more than 28 years,” said Chair Ernst. "One bouquet at a time, Jessica has created beautiful arrangements for countless occasions – from displays for Governors Chet Culver and Terry Branstad to serving as a longtime vendor at the Adams County Fair. Lone Arranger is beloved for its high-quality products and attentive customer service, all stemming from hard work that has not gone unnoticed." Lone Arranger got its start as the “Flower and Garden Center” founded by Dale and Caroline Jackson out of their home. Over the years, the business passed into the hands of Larry and Sherry Archer, followed by Ros and Darlene Peterson. In 1999, Jessica Wilson purchased the shop after completing two internships there and earning a degree in floriculture from Kirkwood Community College. Today, under Jessica’s leadership, Lone Arranger has continued to grow its presence both locally and beyond. The shop contributed to the award-winning Rain Bird float featured in the 2010 Tournament of Roses Parade and has provided decorations for community organizations and events, including the Adams County Chamber of Commerce. The florist is cherished by Iowans for its versatility to cater to all events, including proms, weddings, and baby showers. Jessica’s “Operation Dream Closet” helps high schoolers in need access free prom attire through donations and has made an exceptional difference in the local community. Stay tuned as Chair Ernst continues to recognize outstanding Iowa small businesses with her Small Business of the Week award. ###

UNCW Business School Students Travel to Prague for Real-Life Consulting Experience by David Glew

This article was contributed by Kestrel Smoot, International Programs Coordinator for UNCW’s Cameron School of Business. During the most recent spring semester, 33 upper-level finance and marketing students from the UNCW’s Cameron School of Business traveled to Prague, Czechia, to participate in an intensive international consulting project. Unlike traditional study-abroad programs, the Prague consultancy project focuses on real client engagement. Each year’s project is entirely new, designed through collaboration between faculty and industry partners to identify a current business challenge that students will address. This year, students worked with MAMS-Champi, a Czech non-alcoholic beverage company that is seeking to expand into other global markets. Throughout the first half of the semester, students attend class at UNCW and prepare for their time abroad by conducting preliminary research, developing analytical frameworks, and organizing themselves into specialized teams responsible for tasks such as marketing strategy, industry analysis, consumer segmentation, and competitive evaluation. The course emphasizes independence and teamwork, requiring students to take ownership of their work, manage deadlines, and collaborate across functional groups. Additionally, faculty serve as advisors, allowing students to navigate the complexities of the project much as they would in a professional consulting environment. Once in Prague, students met with company leadership, toured facilities, and refined their recommendations based on real-time feedback. The in-person component is widely regarded as the most transformative aspect of the program because students must synthesize weeks of work into a cohesive presentation and deliver it to the client, demonstrating professionalism, strategic thinking, and adaptability. Beyond the consulting work, students participated in cultural and educational activities that broadened their understanding of global business environments. They explored Prague’s historic districts, learned about Czech culture, and engaged with local professionals. These experiences helped students understand how economic, regulatory, and social factors shape market opportunities. The Prague consultancy project stands as a defining example of the Cameron School of Business’s commitment to experiential learning, consistently strengthening students’ confidence, enhancing their resumes, and serving as a focal point in job interviews. Employers recognize the value of the hands-on experience and transferable skills students gain, underscoring the program’s role in preparing industry-ready graduates for today’s fast-moving business landscape.

Business Restructuring Review Vol. 25 No. 4 July-August 2026

In This Issue New York Bankruptcy Court: Premature Allegations of Creditor Mistreatment Insufficient to Deny Chapter 15 Recognition of Foreign Restructuring Proceeding In In re ARD Finance, S.A., No. 25-12794 (MG), 2026 WL 817458 (Bankr. S.D.N.Y. Mar. 25, 2026), the U.S. Bankruptcy Court for the Southern District of New York was presented with a petition seeking chapter 15 recognition of Luxembourg's recently enacted bankruptcy law governing judicial reorganization proceedings. The court granted the petition, turning aside challenges to recognition voiced by a creditor group arguing that recognition should be denied based upon allegations of unfairness to creditors in the Luxembourg proceeding that would make recognition manifestly contrary to U.S. public policy. According to the bankruptcy court, recognition was warranted because: (i) the rules and procedures governing the proceeding under Luxembourg law were fundamentally fair; (ii) the petition otherwise satisfied chapter 15's recognition requirements; and (iii) the creditor group's allegations were premature, given the fact that the Luxembourg court presiding over the debtor's restructuring proceeding had not confirmed a restructuring plan, and all creditors had the right to participate fully and voice their objections in the proceeding (including the right to appeal an order approving a plan). Apr. 6, 2026), the U.S. Bankruptcy Court for the Southern District of Florida granted in part and denied in part post-recognition motions filed by an insider of a foreign debtor seeking to bar or limit discovery sought by the debtor's foreign representative concerning allegedly voidable transfers involving the debtors' U.S. real property. According to the court: (i) although chapter 15 includes its own discovery provisions among the relief that may be granted to a foreign representative, the expansive discovery available in cases under other chapters of the Bankruptcy Code is also available in chapter 15 cases; (ii) the discovery sought by the foreign representative was permissible; (iii) discovery regarding matters that were the subject of a pending adversary proceeding had to be undertaken under the more restrictive rules applicable to such proceedings; and (iv) a discovery request would be barred to the extent that it sought production of documents or testimony from a subpoenaed entity that exceeded the geographic limitations specified in such rules. (In re Credito Real S.A.B. de C.V. SOFOM, E.N.R.), 677 B.R. 192 (D. Del. 2026), appeal filed, No. 26-2356 (3d Cir. June 5, 2026), the U.S. District Court for the District of Delaware affirmed a bankruptcy court order granting chapter 15 recognition to a Mexican "concurso mercantile" proceeding and enforcing nonconsensual third-party releases approved by the Mexican court. Agreeing with the bankruptcy court that the releases were not manifestly contrary to U.S. public policy, the district court concluded: "It is well settled that U.S. bankruptcy courts can give effect to foreign orders in recognized foreign proceedings pursuant to the authority granted in Chapter 15, even when those orders contain relief unavailable under U.S. law. [The appellant's] arguments misconstrue the Supreme Court's narrow holding in Purdue, applicable in Chapter 11 cases, as well as the statutory framework of Chapter 15 and its core policy objectives. Accordingly, I will affirm the Enforcement Order." The ruling has been appealed to the U.S. Court of Appeals for the Third Circuit. EP Energy E&P Co., LP (Matter of EP Energy E&P Co., LP), 169 F.4th 609 (5th Cir. 2026), the U.S. Court of Appeals for the Fifth Circuit affirmed lower courts' rulings disallowing a creditor's administrative expense claim. It also rejected the creditor's argument that, because the claims were predicated on state law, a state court should adjudicate the merits of the state law causes of action before the bankruptcy court could allow or disallow the claim as an administrative expense. According to the Fifth Circuit, even though the causes of action were based on state law, the bankruptcy court had jurisdiction to determine whether the creditor's claims should be conferred with administrative expense priority in the debtors' chapter 11 case. Ltd., No. 25-10745 (PB), 2026 WL 592250 (Bankr. S.D.N.Y. Mar. 3. 2026), the U.S. Bankruptcy Court for the Southern District of New York considered the bona fides of an involuntary chapter 11 petition filed by certain holders of U.S. dollar-denominated notes against a holding company for a group of Chinese property development companies that filed a restructuring proceeding in the Cayman Islands after the noteholders filed the involuntary chapter 11 petition. The court denied the debtor's motion to dismiss the chapter 11 case. Given the timing of the filing of the Cayman Islands restructuring proceeding, the absence of any progress in the proceeding for seven months, the debtor's need to restructure notes governed by U.S. law, and the debtor's lack of any meaningful contacts to the Cayman Islands, dismissal of the chapter 11 case was unwarranted under the applicable provision of the Bankruptcy Code, international comity, or the doctrine of forum non conveniens. Union, No. 24-70277-JAD, 2026 WL 560452 (Bankr. W.D. Pa. Feb. 27, 2026), a chapter 7 trustee sought court approval to sell certain avoidance actions to a creditor of the debtor's estate. Potential targets of the subject avoidance actions objected, arguing that such claims were nontransferable powers of the trustee rather than saleable estate property and urging the court to approve their competing settlement with the trustee. The U.S. Bankruptcy Court for the Western District of Pennsylvania disagreed with the potential defendants, holding that they lacked standing to object to the proposed sale, that avoidance actions are indeed estate property, and that the sale—rather than the settlement—best served the estate's interests. Buddy Ayers Construction Inc., No. 25-6, 2026 WL 1686028 (U.S. June 11, 2026), the U.S. Supreme Court overturned a Fifth Circuit decision judicially estopping a chapter 13 debtor from asserting a personal injury claim against a construction company because the debtor failed to disclose the claim during his bankruptcy case. In so ruling, the Court held that "[t]he Fifth Circuit erred by artificially narrowing its inquiry to whether the debtor had knowledge of the underlying facts or a potential motive to conceal the claim." It represents the first time that the Court has applied judicial estoppel in the bankruptcy context, although it has suggested in other contexts that it may be inappropriate where an inconsistent legal position resulted from "inadvertence or mistake." Also in June, the Court denied petitions for certiorari in a few notable bankruptcy cases. Nicholas J. Morin (New York) was quoted in an article titled "Serta Ruling Offers Damages Road Map in Lender-on-Lender Disputes," published by Bloomberg Law on July 7, 2026. The article discussed U.S. Bankruptcy Judge Christopher Lopez's July 7, 2026, ruling that participating lenders in Serta Simmons Bedding's 2020 non-pro rata uptier exchange breached the credit agreement's ratable-sharing provision, and awarding excluded lenders more than $261 million in damages. The opinion resolves six years of litigation related to Serta's 2020 transaction, where it raised $200 million in new financing and exchanged $1.2 billion of term loans for $875 million in superpriority debt. Judge Lopez found that the debt-for-debt exchange constituted a "payment" under the credit agreement, requiring proportional sharing among lenders, and dismissed various defenses raised by the participating lenders. The case is Serta Simmons Bedding LLC v. AG Centre Street Partnership (In re Serta Simmons Bedding LLC), 2026 WL 1968535 (Bankr. S.D. Tex. Jul. 7, 2026). Good Communication Is Good Business by Geoffrey Losee

The following column was contributed by J.D. Fisher. Mixed-use communities are increasingly common. Restaurants, breweries, retail stores, entertainment venues, and professional offices often operate within walking distance of established neighborhoods. That proximity creates tremendous opportunity, but it also means that a business's decisions may affect more than just its customers. Many business owners understandably focus on obtaining the permits necessary to open their doors. However, municipal approval is rarely the end of the conversation. As a business evolves, whether by adding outdoor seating, live entertainment, extended operating hours, or other new amenities, the applicable zoning ordinance may require additional approvals or impose operational standards designed to balance commercial activity with nearby residential uses. From a business perspective, the question should not simply be, "Can we do this?" It should also be, "Have we communicated with everyone who may be affected?" Recent local news coverage highlighted how differing interpretations of a municipal ordinance can quickly become the subject of public hearings, legal arguments, and significant uncertainty for a business. While every situation turns on its own facts, one common theme emerged: practical solutions are more difficult to achieve if communication breaks down. Businesses can often reduce that risk by engaging early with the relevant stakeholders. That begins with municipal staff. Planning departments are oftentimes willing to discuss how an ordinance applies before substantial investments are made. Seeking clarification in advance may identify permitting requirements or operational limitations that can be addressed proactively rather than after enforcement action. Communication should not stop with local government. Nearby property owners and neighborhood representatives frequently appreciate being informed about proposed changes before they occur. A brief meeting, an informational email, or an invitation to discuss concerns can foster goodwill and reveal potential issues while there is still flexibility to adjust operations. That’s why such meetings often required for substantial projects and may be a good idea even if not required. Perhaps most importantly, businesses should view compliance as an ongoing process rather than a one-time event. Operational changes that seem minor from a business standpoint may have regulatory implications under local development ordinances. Periodically reviewing proposed changes with experienced land-use counsel or planning professionals can help identify issues before they become disputes. No ordinance can eliminate every conflict between commercial activity and residential expectations. Nor should every disagreement become a legal controversy. But businesses that invest in transparent, proactive communication place themselves in the strongest position to protect both their operations and their relationships within the community. In today's regulatory environment, good communication is more than good public relations, it is good risk management. If your business is planning to expand its operations, introduce a new use, or simply wants to better understand how local land development regulations apply, the attorneys at Rountree Losee LLP are available to help. Our land use and local government practice works with businesses throughout southeastern North Carolina to navigate municipal approval processes, identify potential issues before they become disputes, and keep projects moving forward with confidence.
