Building the beat: How New Orleans can grow the business behind the music
People dance to the music of the TBC Brass Band Photo by Michael DeMocker / The Times-Picayune This week New Orleans hosts the annual Cutting Edge CE Conference, which brings together members of the music industry, musicians, lawyers and others to learn about and discuss the latest changes in the business of making, producing and selling music. googletag.cmd.push(function() { googletag.display('ad-1492300'); }); The conference comes as AI and streaming are causing upheavals in the industry. Meanwhile, we’ve seen at least a partial collapse of the global festival industrial complex which has long been a key financial lifeline for many artists.All of that can feel a bit removed from life in New Orleans. After all, we are a city filled with music. On any given day or night, there are dozens of shows across the city, ranging from jazz and blues to hip-hop, bounce and house. Whereas in other cities kids dream of being the star of their local sports team, in New Orleans more often than not they dream of leading their own band.And music is a huge part of our economy. Before New Orleans was known as a foodie destination, it was already drawing millions of visitors from around the globe to experience our jazz, soul and funk scenes firsthand.But the reality is, if you want to make it big, you’re probably going to end up leaving the city. We’ve seen major performers like Lil Wayne, Master P and Jon Batiste (though he’s back on the Northshore) decamp to Los Angeles, Miami and New York. Likewise, up-and-coming musicians like Greer Grimsely, $leazy EZ and Lucky Daye have also left town in search of more profitable pastures.Meanwhile, our local universities train some of the best producers and engineers in the business — only to see them head to one of the big music industry cities after graduation.It’s not a new phenomenon, though the reasons have changed over the years. Like a lot of early jazz musicians, Louis Armstrong famously left New Orleans, first for Chicago before ultimately settling in New York City. But while those early migrations had more to do with racism, in today’s day and age, musicians end up leaving because New Orleans doesn’t have the industry infrastructure necessary to sustain the kind of growth and, well, success, a lot of folks dream of.It’s a hard, but very real, truth. Artists have to go to Nashville for publishing, Los Angeles for production, Atlanta to join a label or New York for representation. That, in turn, is a drain not only on the city’s talent pool but on money that could be staying here at home.Not being an industry town inevitably makes it that much harder for musicians who don’t leave to get the recognition and success they deserve. It also undoubtedly plays a part in keeping the wages working musicians in New Orleans make at their gigs here lower than in places like Austin or Nashville.That’s not to say we don’t have any of the infrastructure needed to make New Orleans a music industry town. We’ve got live music venues, studios, record labels, management companies, copyright attorneys ... all the various building blocks are there. We just haven’t ever built upon that solid foundation. googletag.cmd.push(function() { googletag.display('ad-1492297'); }); The question is how do we do that in a way that supports our existing industry and artists, respects our cultural traditions and ensures the wealth generated is equitably distributed so it isn’t just C-suite executives who end up reaping the benefits. And the time to start figuring out the answers is now: next year the legislature will focus on taxes and spending, making it vital that New Orleans leaders have a plan to try and secure funding to help grow our industry.So we asked a group of New Orleanians to give us their thoughts, ranging from industry attorneys and venue operators to working musicians and cultural advocates. Their answers point toward turning New Orleans into a music industry city without leaving musicians behind or abandoning what makes us the greatest music city on earth.If a dusty city like Austin can transform itself into a major hub not just for music but the industry behind it, surely the birthplace of jazz — and pretty much all modern music by extension — can figure it out as well. +3 Mailbox Money: The Recording Academy’s Reid Wick on supporting, and growing, New Orleans’ music industry Reid Wick has been a part of the New Orleans music landscape from virtually every angle. When It Comes to Fusion, Materials Matter
Fusion at high temperatures powers the sun and, if harnessed, could provide a potential source of energy here on Earth. But controlling fusion reactions has other benefits. The process also generates subatomic particles called neutrons that are used in a range of applications spanning medicine, research, and national security. Now, scientists at the University of California, Davis (UC Davis), and the Department of Energy’s Lawrence Berkeley National Laboratory (Berkeley Lab) have found that the materials surrounding a fusion reaction can dramatically increase how often it occurs, particularly at low energies where fusion is rare. The study was published July 18 in Nature Communications. Their approach sets up a way to study and engineer nuclear reactions within solid materials, opening a new field of “materials-driven fusion.” Instead of designing materials just to survive the harsh conditions of fusion, researchers might be able to design materials that boost the reaction in specific conditions, similar to the way catalysts speed up chemical processes. “It gives you a new knob to turn that you didn’t have before,” said Arun Persaud, head of the Fusion Science & Ion Beam Technology group in Berkeley Lab’s Accelerator Technology & Applied Physics (ATAP) Division. “If we understand this effect better, it opens the door to engineering new materials that would affect the fusion rate under certain conditions. Someday future progress might enable more compact and efficient neutron generators, which have all kinds of applications, like cargo screening, planetary science, and medical therapy and imaging.” In the experiment, researchers used two different methods to pack deuterium, a heavy form of hydrogen atoms that is often used in fusion, into thin foils of palladium and titanium. They then fired a beam of deuterium ions at the foils at different energies and measured how often fusion happened. Then they compared the rates from the different materials and methods with the “bare” fusion reaction (not in a material). The team found that fusion rates depended on how the deuterium was loaded into the metal foils. The biggest effect was at the lowest energies, below 2.5 kiloelectronvolts (keV), where theory predicts fusion rates drop off sharply. Instead, researchers found a surprising plateau: Some samples showed elevated fusion rates roughly a quintillion times higher than bare fusion reactions. (A quintillion is a 1 followed by 18 zeroes.) Researchers are not exactly sure why that’s happening, though they have some ideas and ways to test them. The electrons and defects within the material might partially shield repulsive electrostatic forces between deuterium nuclei, making it easier for them to get close together and fuse. Tuning the electronic structure, defects, and composition of materials could help make nuclear reactions happen more readily. “It comes down to better understanding the mechanism so that we can try to enhance it,” said corresponding author Jeremy Munday, a professor at UC Davis. “We’ve seen that we can increase fusion rates, but what is the limit? Can we bring it to lower temperatures or energies? There’s obviously a lot of interest and excitement about fusion, so if there’s something we can learn about the physics at these lower energy scales, maybe there’s something we can translate to other areas of nuclear science.” The team plans to explore a wider range of materials and continue probing the unexpected fusion plateau at lower energies. Their work establishes a reproducible experimental platform to study how solid materials influence nuclear reactions, creating a new area of research that links fusion science with materials science and chemistry. “The work shows conclusively that the material environment where fusion occurs at low temperatures is an active participant rather than a passive container,” said Cameron Geddes, director of ATAP. “That adds a new dimension to fusion research.” This work was funded by the U.S. Department of Energy’s Advanced Research Projects Agency-Energy (ARPA-E). ### Lawrence Berkeley National Laboratory (Berkeley Lab) is committed to groundbreaking research focused on discovery science and solutions for abundant and reliable energy supplies. The lab’s expertise spans materials, chemistry, physics, biology, earth and environmental science, mathematics, and computing. Researchers from around the world rely on the lab’s world-class scientific facilities for their own pioneering research. Chico City Council approves entertainment zones for downtown and Meriam Park
CHICO, Calif. - Chico City Council voted 6 to 0 to approve an ordinance creating entertainment zones in downtown Chico and Meriam Park.The ordinance, taking effect September 18, 2026, will allow customers to carry approved alcoholic beverages and walk around outside within those designated areas."I feel like the downtown could use all the help it could get right now," said Celeste Cramer, general manager of Downtown Chico Business Association. "In the other areas where they have been doing the entertainment zones and throughout California, it has increased their sales. They haven't seen an increase in violence, or tickets, or anything like that. It's a good thing to try out."Numerous other cities around California such as Redding, Sacramento and San Francisco have put their own entertainment zones into effect and have had success.Action News Now stopped by both designated locations and spoke with organizers and bar owners."I'm super excited, I think this is an opportunity for us," said Scott Baldwin, owner of Argus. "We can get a booth at the farmers market. You can order a cocktail from that booth and then we'll have it ready for you at the door as you walk through. Think of it as a picnic situation. You can grab some tacos, you can get a Kentucky Buck. You can sit down anywhere in the entertainment zone and enjoy Argus outside of Argus."Chico's Chamber of Commerce hosted community stakeholder meetings and community engagement sessions to tailor the ordinance to the city's needs as a university town and rural area.The ordinance will allow people 21 and older to walk around with open containers of alcohol within the entertainment zones as long as they have a wristband, stamp or another visible marker showing they're allowed to do so."To us it's more than an ordinance," said Jen Rothenwander, marketing manager at Meriam Park. "It's an opportunity to invest back into the community, and to continue to do what Chico does well – which is to create the spaces for people to stick around and gather, and shop and spend."The Meriam Park entertainment zone will be enclosed by Springfield Drive, Alcott Avenue, Notre Dame Boulevard and E. 20th Street.The Downtown Chico entertainment zone will span mostly from Highway 32 to Lost Park.Chico Chief of Police Billy Aldridge spoke with Redding Police and was informed they had zero problems with their entertainment zone.Chief Aldridge endorses the ordinance in Chico. freestar.config.enabled_slots.push({ placementName: "actionnewsnow-com_blox_yup-rectangle-one", slotId: "actionnewsnow-com_blox_yup-rectangle-one", targeting: { "pos": "yup-rectangle-one" } });

Business Restructuring Review Vol. 25 No. 3 May-June 2026
In This Issue Texas Bankruptcy Court Adopts Barnet Rule Requiring Foreign Debtor to Have U.S. Assets to Be Eligible for Chapter 15 Relief In In re Siu-Fung Ceramics Holdings Limited, No. 24-33299, 2026 WL 382424 (Bankr. S.D. Tex. Feb. 10, 2026), the court denied petitions for chapter 15 recognition of Hong Kong bankruptcy and liquidation proceedings commenced on behalf of an individual debtor and a group of companies that he owned or controlled. According to the court: (i) the corporate debtors' Hong Kong liquidation proceeding was not eligible for chapter 15 recognition because the attorney retainer upon which such relief was based was not funded until nine months after the chapter 15 petition date; and (ii) the individual debtor's Hong Kong bankruptcy case could not be recognized because the debtor's "center of main interests" on the chapter 15 petition date was not in Hong Kong, and he did not even maintain an "establishment" there. Tex. 2026), appeal filed, No. 26-20166 (5th Cir. Apr. 14, 2026), cross appeal filed, No. 26-20166 (5th Cir. Apr. 24, 2026), the U.S. District Court for the Southern District of Texas addressed consensual third-party releases and gatekeeping provisions in the aftermath of the U.S. Supreme Court's ruling in Harrington v. Purdue Pharma L.P., 603 U.S. 204 (2024). Consistent with existing Fifth Circuit precedent, the court confirmed that, in appropriate circumstances, consent for third-party releases may be obtained through a creditor's failure to opt out of granting that consent. But, the court ruled, consent through an opt-out mechanism essentially can never be inferred for creditor classes that stand to receive no recovery under a chapter 11 plan and that are deemed to reject the plan by operation of applicable bankruptcy law. Instead, those classes must affirmatively opt in to any release. The court also narrowed and remanded the bankruptcy court's acceptance of a broad gatekeeping provision, ruling that such provisions must correspond to the restrictions established by Fifth Circuit precedent. The Bankruptcy Code also permits recovery of an avoided transfer from not only the initial recipient, but also from subsequent transferees. Courts disagree over whether a transfer must actually be avoided before the trustee can seek recovery from a subsequent transferee and whether the initial transferee must also be a defendant in the recovery litigation against a subsequent transferee. The U.S. Bankruptcy Court for the District of Delaware weighed in on this debate in Phillips v. SS Associates LLC (In re ONH AFC CS Investors, LLC), No. 23-10931 (CTG), 2026 WL 312892 (Bankr. D. Del. Feb. 4, 2026). The court adopted the majority view, ruling that the initial transferee need not be a defendant in avoidance and recovery litigation against a subsequent transferee, but that the trustee must establish the elements necessary to avoid the initial transfer as part of the recovery litigation. [read more …] New York Bankruptcy Court Weighs In on Adequate Assurance of Future Performance under Assigned Leases and Chapter 11 Plan Exculpation Provisions In order to assume and assign an executory contract or unexpired lease, a bankruptcy trustee must cure most defaults under the agreement and provide "adequate assurance" of the assignee's future performance. However, the Bankruptcy Code provides no guidance as to the meaning of "adequate assurance" other than with respect to shopping center leases. In In re Broadway Realty I Co. LLC, No. 25-11050, 2026 WL 147505 (Bankr. S.D.N.Y. Jan. 19, 2026), the U.S. Bankruptcy Court for the Southern District of New York examined this issue in connection with a proposed assignment of thousands of residential leases as part of a free-and-clear sale of debtors' properties. The court held that "adequate assurance" does not mean a guarantee of the assignee's future performance, but merely demonstration that the assignee has the ability to satisfy the underlying obligations. The bankruptcy court also ruled that an exculpation provision in the debtors' chapter 11 plan exonerating non-estate fiduciaries from liability for actions taken in connection with the chapter 11 case was unobjectionable, provided it was limited in scope to postpetition conduct and actions taken in connection with implementation of the plan after its effective date.
