In its October 23 Rand v Eyesmart decision, the 5th Circuit held that everyday shopping and scheduling activity on a healthcare-adjacent website can possibly count as protected health information, even when customers never typed in a diagnosis or symptom. For businesses like optical chains, pharmacies, dental practices, wellness providers, and telehealth platforms, the decision means higher litigation risk tied to particular data flows and identification practices, rather than a categorical prohibition on website analytics or advertising tools. Here’s what happened, what the court decided, and seven steps to consider now.
