What will that mean for patients? For more information on dementia research, find Pam Belluck’s latest reporting at the New York Times. Bonus 236: A Term of Self-Inflicted Wounds

Within minutes of the Supreme Court handing down the birthright citizenship ruling on Tuesday and rising for its summer recess, its defenders were pointing to that decision (alongside the late-arriving mail-in ballots ruling on Monday and the tariffs ruling from February) as decisive proof that the Court really is “above politics,” and that criticisms of the justices for behaving more like politicians in robes than like judges are thus unfair. For a particularly thoughtful version of this claim, see Professor Will Baude’s opening response to the latest New York Times written roundtable about the Court with Baude, Professor Kate Shaw, and me. In that roundtable, I already offered one of the two major arguments against this thesis—that it’s an assessment of the numerator without regard to the denominator, and that a full account of the Court’s behavior throughout OT2025 suggests that the Court behaved even more politically during the current term than during even the previous (highly politicized) one. Just to take one of many data points, last term (OT2024), there were six rulings in argued cases in which all six Republican-appointed justices were in the majority and all three of the Democratic appointees were in dissent (along with a slew of such rulings on the emergency docket). This term, there were … 13. (Along with two 6-3 summary reversals and 10 rulings on the emergency docket from which the three Democratic appointees all dissented.) Today’s bonus issue addresses the flip side of that coin. In particular, below the fold, I identify four different moments in which the justices could have acted in ways to specifically defuse charges of political behavior—and opted instead to lean all the way in. As much as end-of-term narratives focus on what the Court did, and on the takeaways from individual rulings, consider today’s post an attempt to identify opportunities that the Court missed, as well. At least in the examples discussed below, by opting for the outcome that made the Court look more transparently political, the Court inflicted a series of (unnecessary) credibility wounds on itself. For those who aren’t paid subscribers, we’ll be back Monday with our regular coverage of the Court. For those who are, please read on.

Is the FDA Really Suppressing Science? Plus. . .

It’s Thursday, May 7. This is The Front Page, your daily window into the world of The Free Press—and our take on the world at large. Today: Aaron MacLean says Trump is poised to snatch defeat from the jaws of victory in the Iran war. Joe Klein on the life of CNN founder Ted Turner. Jillian Lederman on why cruise ships are here to stay. And much more. But first: Is the FDA suppressing science? On Tuesday, The New York Times published a story with an alarming takeaway. “FDA Blocked Publication of Research Finding Covid and Shingles Vaccines Were Safe,” read the headline. It is the latest in a string of stories that all have the same message: The Food and Drug Administration (FDA), and other agencies, are engaged in a cover-up—and silencing scientists trying to get the word out about the Covid vaccine. What all these stories suggest—some more subtly than others—is that the outsiders now running the public health establishment, officials such as Marty Makary at the FDA and Jay Bhattacharya at the National Institutes of Health, are on a revenge tour. That they are doing harm to the country to get back at the scientists and bureaucrats who ostracized them for deviating from the public-health consensus during the pandemic. Metropolitan Police officers have been placed on administrative leave and could face termination after an internal investigation found evidence that crime statistics were manipulated to make the city look safer. The Republican-led House Oversight Committee previously alleged that former D.C. police chief Pamela Smith pressured officers to skew data. Tennessee Republicans unveiled a redrawn U.S. House map yesterday that would split up Memphis’s black-majority Democratic district, the latest move in a nationwide push to redraw congressional boundaries ahead of the midterms. The effort follows a Supreme Court ruling last week on Louisiana’s districts, which Tennessee House Speaker Cameron Sexton said gave states the green light to redraw maps along partisan lines. Israel struck Beirut for the first time since a ceasefire with Hezbollah took effect last month, saying it targeted a commander of the militant group’s elite Radwan force in the city’s southern suburbs. Weeks before a former JPMorgan investment banker filed a lawsuit packed with explosive allegations, the bank reportedly offered him $1 million to settle his sexual assault and harassment claims, according to The Wall Street Journal. The suit, filed by Chirayu Rana, alleges he was sexually assaulted by a female colleague, subjected to racial discrimination, and forced into a degrading dynamic at work. JPMorgan says the claims lack merit, and the female colleague’s lawyers call the accusations fabricated. A new report from the Hartford Institute for Religion Research shows that, for the first time in roughly 20 years, church attendance is trending upward, with more people volunteering and clergy expressing renewed optimism. The study’s authors described the findings, based on a survey of more than 7,400 congregations, as showing signs of widespread recovery from low attendance numbers.

EDITORIAL: Normalization of misconduct in U.S. politics

President Donald J. Trump's 2016 presidential campaign propelled conversations regarding sexual assault into the national spotlight. A handful of women slowly began coming forward with allegations of unwanted advances and perverse comments over the course of the election cycle, and concerns were further solidified after a secret recording from a 2005 Hollywood Access tape was leaked. Trump had been caught on a hot mic stating he was able to touch women as he pleased, and due to his social status as a "star," they would let him do it. The New York Times published a series of interviews from individuals who had both witnessed and experienced his inappropriate behavior soon after.

Pulitzer Prize winner shares historic nature of politics as U.S. celebrates 250th anniversary

Pulitzer Prize-winning historian and New York Times bestselling author Jon Meacham discussed the nature of American politics through pivotal moments in U.S. history. Meacham said that the nation was originally founded on the notion of politics as “an aspirational arena of contention,” where different interests were disputed before reaching a consensus. He added that conflicts regarding power and other matters are inevitable.

The Death of Public Health

During the recent measles outbreak, the largest in more than 30 years, Robert F. Kennedy Jr. refused to clearly recommend the measles vaccine, saying instead that it was a “personal decision,” and that parents should “do their own research.” Similarly, during her recent confirmation hearing for United States Surgeon General, Casey Means was questioned by Senator William Cassidy (R, La). “You’re the nation’s doctor,” said Cassidy. “Would you encourage [a mother] to have her child vaccinated!” “I’m not an individual’s doctor,” Means said. “And every individual needs to talk to their doctor before putting a medication in their body.” In June 2025, Marty Makary, Commissioner of the Food and Drug Administration (FDA), said that COVID vaccines for pregnant women should be a “personal choice”, even though every other country in the world recommended the COVID vaccine during pregnancy due to a higher risk for severe disease. It doesn’t end there. On January 5, 2026, RFK Jr. reduced the number of routinely recommended vaccines from 18 to 10. For vaccines that protected against influenza, COVID, and rotavirus, parents were urged to speak with their doctors—to make an individual choice. (On March 16, 2026, in a ruling by a federal court in Boston, RFK Jr.’s revised schedule was invalidated.) What’s happening? Why are public health officials moving away from making recommendations for the public? The origin of this change might be rooted in the first two years of the COVID pandemic. In 2020, during the first year on the pandemic, we didn’t have anything to stop a virus that was killing hundreds of people a day and could be spread asymptomatically. We didn’t have antivirals until October, monoclonal antibodies until November, and vaccines until December. All we could do was restrict travel, close businesses, shutter schools, and mask, isolate, quarantine, test, and social distance. During the second year of the pandemic, when we had vaccines to prevent COVID, people couldn’t go anywhere without their vaccine cards. They couldn’t go to their favorite bar or restaurant or sporting event or place of worship without proof of vaccination. Some people were fired from their jobs for refusing to get vaccinated. For many, this was seen as massive government overreach and energized what has been called the “medical freedom movement.” Indeed, a headline in the New York Times declared, “How Health Freedom Became a Winning Rally Cry.” As expressed in the comments of RFK Jr., Casey Means, and Marty Makary, the medical freedom movement focuses on the individual not the community—the opposite of public health. In an article titled “Ethics and Social Value Judgments in Public Health,” ethicists from Yale University distinguished public health from medical freedom. “Public health policies,” they wrote, “are population oriented. Because individual health affects the health of others, public health measures regulate individual behavior to achieve population health goals. All raise questions about how individual autonomy and freedom should be balanced against public health interests…which respects individuals’ sovereignty over their bodies and actions as long as their actions do not harm others.” The medical freedom movement fails to recognize that it often limits the freedom of others. For example, a parent who is afraid to send a child to school where many of the students are unvaccinated. Or immune compromised children who depend on those around them to for protection. The question then becomes “Freedom for whom?” Is it your right, in the name of medical freedom, to catch and transmit a potentially fatal infection—and in so doing, take away the freedom of others? In Four Essays on Liberty, Isaiah Berlin sums it up best. “Liberty for the wolves,” he wrote, “is death to the lambs.” Thanks for reading Beyond the Noise!
