Is Germany benefitting yet from the crisis in US research?

Science|Business - Table.Media partnershipScience|Business has partnered with Table.Media, a leading source of news about higher education and research in Germany. Each week, we are publishing one of each other’s stories to give readers an even broader range of insight into R&D policy across Europe.Drawing over 500 participants, the German Academic International Network conference in San Francisco brings together researchers, universities, scientific organisations and policymakers in the US as part of an attempt to recruit international talent for Germany. It also serves as an annual barometer for the uncertainty triggered by the Trump administration’s science policies. As was the case last year, Germany’s political presence was unusually strong: federal lawmakers, nine state ministers of science and research, and federal research state secretary Marcus Pleyer all attended. Joybrato Mukherjee, president of the German Academic Exchange Service (DAAD), has observed a marked shift at US universities a year after the Trump administration began sweeping interventions: the initial state of "shock and paralysis" has given way to a strategic approach to the situation. Universities are seeking new funding sources, mounting legal challenges against interventions and opening themselves up more to international collaborations, including with Germany, he said. Early-career international researchers with expiring visas are considered particularly vulnerable. Germany is benefiting from increased demand among this pool of young talent; the country’s 1,000 Minds Plus programme, designed in part to lure German academics back home, has already filled up around one-third of its capacity. Meanwhile, Markus Blume, Bavaria’s science minister and current chair of the federal Conference of Science Ministers, sees an "enormous outflow of talent from the US." An increasing number of international researchers want to leave. Applications to Canada have risen by 42% January, and those to Europe by 32%. Meanwhile, the number of people drawn to the US is plummeting. "In this context, Germany must position itself as a prime destination offering reliable conditions, institutional stability and academic freedom, including through smart collaborations," Blume told Table.Briefings.“Darkest hour”At the get-together in San Francisco, the former president of the US National Academy of Sciences, Marcia McNutt, highlighted the gravity of the situation on the ground in a keynote address. She described the present moment as the "darkest hour for the US scientific system." At the same time, she said that cooperation should be maintained, especially during a crisis. Established researchers in the US are less likely to leave. Ulrike Malmendier, a former member of the German Council of Economic Experts and an economist at Berkeley, explained why established researchers are not packing their bags and leaving the US in droves: working conditions and the concentration of talent at places like Berkeley and Stanford remain unparalleled. According to Peter-André Alt, managing director of the Wübben Foundation, which helps Germany attract international academics, political restrictions are not the only grievance voiced by US-based researchers. "There are evidently still many areas where, fortunately, unfettered research is possible," Alt told Table.Briefings. Instead, the primary complaint concerns the cost of living, which has "skyrocketed” to absurd levels. "Runaway inflation, like that currently seen in the US, is certainly no draw for young scientific talent,” he said. Return homeA growing number of early-career researchers from Germany appear to be considering a return home. Jörn Benzinger, who is responsible for recruiting early-career researchers from abroad at Ruhr University Bochum, reports numerous conversations with researchers who are taking a closer look at the German academic landscape."Germany has definitely moved more into the spotlight,” he said. States, university alliances and research organisations joined forces to recruit talent. Bavaria, Baden-Württemberg and North Rhine-Westphalia were prominently represented, as were alliances such as the Berlin University Alliance and the University Alliance Ruhr. Benzinger sums up Germany’s approach with a new formula: "collaboration is the new competition." He notes that it is becoming increasingly difficult for individual universities to gain international visibility, while regional research ecosystems and collaborations are growing in importance. Afraid to leaveThe crisis in the US academic sector is also straining transatlantic research relations. Benzinger reports that some US-based researchers had to decline brief invitations to Germany because they could not be certain of being allowed to re-enter the US afterward. He considers the simple poaching of researchers to be the wrong approach; what is needed, he says, are "reliable offers and long-term partnerships."However, Green Party politician Ayşe Asar, who also attended the conference, sees a significant need for improvement, particularly regarding career paths in Germany. While lifetime professorships and academic freedom certainly make Germany attractive, young researchers also require predictable career paths, tenure-track positions and flatter hierarchies.

Boston Scientific hit by cyberattack causing ‘disruptions’ to parts of its business

This year has seen a growing number of medtechs hit by cyberattacks, and now Boston Scientific has become the latest victim. In an SEC filing posted Aug. 26, the medtech giant said it had detected a “cybersecurity incident” the day before. The incident has affected certain parts of its information technology systems, something that “has resulted in a global disruption to the company’s operations.” The incident has hit not just its information systems but also its business applications, which “support aspects of the Company’s operations,” it said in the filing. This includes its ability to process and ship customer orders. Boston Scientific said it is working to restore the systems, but the timeline remains unknown. Related Baylor Genetics hit by cybersecurity attack targeting patient, staff information As the company investigates the incident, it remains unclear how significantly its business will be affected. “Accordingly, the Company has not yet determined whether the incident is reasonably likely to have a material impact.” The company’s shares were down 3.5% in premarket trading as the news broke. This adds another layer of pressure for the medtech, which last month revealed a new global restructuring program that starts this year and is slated to be completed by 2029. The company said at the time that it “does expect some headcount reductions to result from these restructuring activities,” but did not provide any numbers or specify areas where the cuts may be made. It added, however, that new jobs are also set to be “created in areas of growth.” It was also forced to cut its sales guidance in Q2, saying in late July that it now expects full-year 2026 organic revenue growth of 5% to 6%, down from its previous guidance of 6.5% to 8%. Boston Scientific is one of a growing number of life sciences companies, notably medtechs, that have been hit by cyberattacks this year. These include Abbott, iRhythm, Medtronic and Stryker, as well as Big Pharmas Amgen and Novo Nordisk.

A deep dive into climate change

Some policymakers continue to question the science of climate change, despite the growing evidence of significant damage to life on land and in the ocean.Katja Matthes, director of the GEOMAR Helmholtz Centre for Ocean Research Kiel in Germany, believes the ongoing attempts to politicise climate science and discredit researchers are hindering international cooperation and public understanding. The ocean provides clear evidence of the extent to which changes are occurring, she says.“We are seeing severe, unprecedented and accelerating changes in the ocean — warming ocean temperatures, acidification and oxygen depletion — that are destabilising the most important system that makes life on this planet possible,” Matthes explains. Visible signs of these changes include the melting of ice sheets in the Arctic and Greenland. Deeper down, the growing frequency of hypoxia — or oxygen-deprived “dead zones”, where marine life can no longer survive — in the Baltic and record-high Mediterranean surface temperatures are indicators of the “dramatic warming” of the ocean, she adds. The ocean, which covers around 70% of the Earth’s surface, acts as a vital carbon sink, absorbing around 30% of the planet’s carbon dioxide (CO2) and 90% of the excess heat. However, the global ocean surface temperature has risen by an average of half a degree Celsius since 1982, according to the EU Copernicus observatory. More significant rises have been recorded in the Mediterranean, Black, Baltic and other shallower seas. Some ocean temperature increases do occur naturally, such as during El Niño events. But sustained rises can trigger extreme weather on land — including droughts, floods and catastrophic storms — while also harming marine ecosystems. Only 10% of marine species have been studied, Matthes notes, “so the consequences might be even more severe than we know.”Fostering European cooperation amid uncertaintyMatthes, who holds a doctorate in meteorology, is a professor of atmospheric physics as well as director of GEOMAR. She serves as one of Kiel’s ambassadors to Science Comes to Town (SCTT), an EU-funded programme that aims to promote science’s role in society and strengthen cross-border collaboration in research, innovation and sustainability. SCTT is hosted by the coastal cities of Kiel, Brest (in France) and Split (in Croatia). The SCTT project also provides a platform for raising awareness and understanding between scientists and the public about major issues, such as climate change. Having worked on both sides of the Atlantic, Matthes is frustrated by recent attempts to erode decades of international climate collaboration and question the credibility of research. Earlier this year, the US administration delivered a major blow to global cooperation by withdrawing from the Intergovernmental Panel on Climate Change (IPCC), the UN Framework Convention on Climate Change and other global climate organisations, claiming they were “contrary to the interests of the United States.”In addition, a US Department of Energy (DOE) report cast doubt on the latest IPCC climate assessment, which was published in 2024. As a contributing author to the IPCC study, Matthes says the DOE sought to discredit scientists like herself. “Climate change is not a matter of opinion, it really exists and we are witnessing dramatic changes,” she notes. “It’s not climate change as a whole that is being targeted, but scientists and their research.”Other US actions have also hit home for Matthes, who spent three years at the US National Center for Atmospheric Research (NCAR) in Boulder, Colorado. The White House has announced plans to close the facility, a move that was “pretty tough” due to the German scientist’s personal connections with the staff and their reputation for excellence.Changing the narrative on climate changeEurope’s scientific community remains a driving force on climate research and collaboration. As one of the world’s leading marine research institutions, GEOMAR attracts students from more than 50 countries and plays an important role in global observation initiatives that contribute to understanding and protecting the ocean basins. At a European level, GEOMAR works closely with other top marine research facilities, including France’s Ifremer, an SCTT partner in Brest. GEOMAR has also developed innovative and safe strategies for removing unexploded wartime munitions from the seabed, which release toxic substances that pose a danger to humans and the marine environment. Through the Horizon Europe MMinE-SwEEPER project, this knowledge has been transferred to the European level. These initiatives are examples of how local action can have a global impact, Matthes says, and how Europe can strengthen climate research and partnerships. “This is a chance for Europe to step up and work on climate cooperation and agreements,” she notes. “Climate change is an international problem and a real threat, and we need more speed on climate action than we have now.”Matthes believes her fellow scientists need to communicate that climate change is not only a threat, but an opportunity to find solutions. “We need to change our narrative and expand our strategic alliances with those who are willing,” she says, “and luckily there are a lot of willing people and countries.”Science|Business, which connects policymakers, academics and industry through its news reporting, analysis and events, is an SCTT partner.

The Apophis encounter in 2029: A rare opportunity for planetary science and defense

The near-Earth asteroid Apophis will make an extremely close flyby of Earth on April 13, 2029, at a distance of approximately 38,000 km—an event that occurs on average only once every 7,500 years, offering an unprecedented opportunity for planetary science and planetary defense. However, significant uncertainties remain regarding the physical parameters of Apophis, such as its shape, spin state, internal structure, and material composition, and predictions of tidal effects—including potential orbital changes, spin acceleration, surface material displacement, and dust ejection during the flyby—are highly dependent on model assumptions. Although multiple nations have planned exploration missions, how to coordinate global observational resources within the limited time window, optimize rapid-response mission architectures, and translate scientific understanding into effective planetary defense strategies remain critical challenges to be addressed.

Small Business Spotlight: Specialty dental practice takes root on Market St.

WHAT MADE YOU WANT TO OPEN BLUE HERON ROOT CANAL SPECIALISTS? OWNER SARAH ERMOSHKIN: “I’ve always been an entrepreneur at heart. When I was 23 years old, I owned a cafe in Seattle, where I even fought to oppose oppressive sales taxes on espresso drinks. After selling that business, I got married and started a family. Once my children were in school, I attended dental school through the Navy Health Professions Scholarship Program (HPSP), which covered my tuition and provided a stipend. From the beginning, my goal was to eventually own my own practice after completing my military service. The work I do is incredibly rewarding and being able to create an environment that puts patients first while helping employees grow professionally makes every day as a business owner meaningful.” WHAT DOES YOUR BUSINESS PROVIDE? ERMOSHKIN: “Endodontists are often called ‘pain doctors’ because our primary mission is to relieve pain and save natural teeth. We specialize in root canal therapy, retreatment of nonhealing root canals, treatment of root resorption, apicoectomies – microsurgical root-end procedures – and vital pulp therapy for children. Our goal is to preserve teeth that might otherwise need to be extracted and replaced with implants. Saving a patient’s natural tooth is almost always the best long-term solution for their oral health.” HOW DOES YOUR MILITARY TRAINING HELP YOUR BUSINESS? ERMOSHKIN: “My military service taught me how to lead, collaborate and make decisions under pressure. I worked closely with senior leadership while treating a large patient population and collaborating with specialists across multiple disciplines. During the COVID-19 pandemic, (I) served a dual role as Navy dentist and as the public affairs officer for Naval Health Clinic Annapolis, where I helped develop medical and dental communications for the midshipmen and support staff, while coordinating with the broader Navy Capital Region. We worked closely with other military treatment facilities to share best practices and deliver consistent public health messaging. Those leadership experiences continue to shape how I lead my team and serve our patients today.” WHAT CHALLENGES ARE YOU FACING RIGHT NOW IN YOUR BUSINESS? ERMOSHKIN: “One of our biggest challenges is overcoming the misinformation surrounding root canal treatment. Root canals are safe, effective and often the best way to relieve pain while preserving a natural tooth. Unfortunately, many people choose extraction because they believe it’s less expensive or because they’ve seen misleading information online. What they may not realize is that losing a tooth can lead to shifting teeth, changes in the way they bite and chew and significantly higher costs to restore their smile later.”

Someone Made a Terrific Deal in the Peacock/YouTube Premium Partnership…But Who?

(Welcome to the “Most Important Story of the Week”, my bi-weekly strategy column analyzing the most important (but often not buzziest) news story of the last two weeks. I’m the Entertainment Strategy Guy, a former streaming executive who now analyzes business strategy in the entertainment industry. Please subscribe.) I hope everyone around the world suffering from record heat waves is doing okay. The temperature is already up in Southern California, but obviously not nearly as bad as parts of Europe. With a super El Nińo coming this year, I worry it will get even worse. Yes, we know what’s causing this heat—it’s the carbon, duh—but we really aren’t making enough progress. I’m not “environmental strategy guy”, but if I were, I’d have some ideas of what I’d try. Honestly, for years I’ve been intrigued by the work of the folks at MEER—whose plan, super simply, is to put up mirrors to reflect heat (while continuing the important work of decarbonization)—but I’m frustrated this idea hasn’t made more progress. (Other geo-engineering groups seem to get better press.) With heat like this—cancelling events, hurting economies and, most importantly, killing people—it seems like the time to push solutions! The “mirrors on the ground” solution has barely been tried.1 While entertainment companies may not “feel the heat”, lots of outdoors/experiential industries—concerts, theme parks and so on—will. Even movie theaters could benefit, since mirrors could help lower AC costs, which I imagine is not an insignificant expense, especially in the hotter areas of the country. So I do think the entertainment industry should prioritize this issue. Anyways, let’s get back into the entertainment strategy. I was about to write, “Hey, this week we don’t have any mergers and entertainment news to dive into,” but that’s not really true, since we had more updates on Paramount-Skydance and Warner Bros. Discovery. But the big story of the week involves a streamer and a Big Tech platform bundling their respective streamers. So I’ll write about the updates on Paramount buying Warner Bros., Versant making some moves, and a whole lot more. But we start with a surprising deal: Peacock licensing their content to YouTube Premium. Let’s dive in! Subscribe Most Important Story of the Week - Peacock’s Pricey Premium Partnership The story of the week is Comcast’s2 NBC-Universal’s Peacock making a deal with Google’s YouTube’s YouTube Premium subscription product to embed their content. And I’ll say this up front: Someone made a terrific deal. The question is who. And I’ll be honest: I don’t know. Let me explain why, including why this deal exists, the pros and cons for each side, the biggest unknown, and what that says about the streaming wars. Customers Love Bundles (But YouTube Has Its Own Issues) We’re just getting started with this issue, but the rest is for paid subscribers of the Entertainment Strategy Guy, so if you’d like to find out… Why customers love bundles… But why I’m worried about YouTube’s integration... How Peacock is trading scale for control… And the reason they likely made this deal... The odd budget math for this deal... Whether or not I think the Paramount-Skydance/WBD deal is more likely after the latest settlement... Versant making moves and why that’s good for Hollywood… Another distributor going out of business… ...and a whole lot more! ...please subscribe! We can only keep doing this great work with your support.

AbCellera women’s health data top ‘most aggressive upside scenario,’ putting Astellas and Bayer on notice

AbCellera has reported phase 2 results “beyond even the most aggressive upside scenario” that its CEO dared to consider, boosting the biotech’s chances of challenging Astellas and Bayer for a women’s health market. The phase 2 clinical trial compared ABCL635, an antibody targeting NK3R, to placebo in patients with hot flashes caused by menopause. Investigators enrolled 92 postmenopausal women experiencing a mean of about 10 moderate or severe hot flashes per day. By Week 4, the number of moderate or severe hot flashes had fallen by a mean of 8.8 on ABCL635 and by 3.5 on placebo. That statistically significant, placebo-adjusted reduction of 5.3 hit the trial’s primary endpoint. The level of efficacy also cleared the bar set by existing drugs. While cross-trial comparisons can be misleading, AbCellera CEO Carl Hansen, Ph.D., had seen enough to start hyping the program. “We now view ABCL635 as a potential best-in-class non-hormonal therapy with strong differentiation against approved NK3R competitors across all important dimensions, including efficacy, safety, dosing and convenience,” Hansen said on a Monday morning conference call with investors to discuss the data. “We believe ABCL635 is now a highly de-risked program.” Last week, Hansen used AbCellera’s earnings call to set expectations for readout, with the CEO defining success as a clean safety profile and efficacy comparable to the two approved small molecules. The data vaulted over that bar. Astellas linked (PDF) one of the small molecules, Veozah, to placebo-adjusted reductions in hot flash frequency of 2.1 and 2.6 at Week 4 of its two phase 3 trials. Bayer reported (PDF) placebo-adjusted reductions of 3.04 and 3.29 at Week 4 of pivotal studies for its small molecule, Lynkuet. At 5.3, the placebo-adjusted reduction in AbCellera’s trial comfortably cleared the standard set by the incumbents. Veozah and Lynkuet came to market based on evidence of their ability to reduce the frequency and severity of hot flashes. AbCellera’s phase 2 study covered both endpoints, with the Canadian biotech reporting a mean reduction in severity of 1.4 points at Week 4 on ABCL635, compared to 0.3 points for placebo. Again, the placebo-adjusted result compares favorably to data on Veozah and Lynkuet. Analysts shared Hansen’s enthusiasm for the data. The phase 2 results “firmly validate ABCL635 as a potentially best-in-class treatment,” BMO Capital Markets analysts said in a note to investors Monday. ABCL635’s apparent efficacy edge “is likely attributable to the higher dosing/target engagement the asset is able to reach vs. the oral agents due to its wider therapeutic index,” the analysts added. The analysts, who model $2.3 billion in unadjusted peak sales for ABCL635, flagged the safety profile as another positive of the phase 2 readout. While Veozah carries a boxed warning for liver damage, nobody on ABCL635 in the phase 2 trial had elevated liver enzymes or bilirubin values. If replicated in phase 3, the lack of a liver signal could allow approval without the monitoring requirements imposed on Veozah. Investors appeared equally enthused, sending AbCellera's stock up 32% to $9.21 in premarket trading Monday from a Friday closing price of $6.93. Next, AbCellera will collect the Week 12 data and talk to its advisors about further development. The results open up “a wide variety of possibilities of how we might take this forward into phase 3 studies to truly maximize the value of the asset and make sure that ABCL635 is able to demonstrate its differentiation potential,” Sarah Noonberg, M.D., Ph.D., AbCellera’s chief medical officer, told investors.

The Business of Immigration: Ethics, Economics, and the Future of Our Region

About this Program: Immigration has long shaped the identity, economy, and culture of the San Diego–Baja California region. Today, it remains one of the most significant—and often most debated—public policy issues facing our communities. As employers grapple with workforce shortages, governments respond to evolving immigration policies, and families pursue opportunity and security, important questions arise about the economic, ethical, and practical implications of immigration for our region's future. As part of the Engage San Diego: Tough Topics, Real Discussion series, moderator Andrew Blum will lead a thoughtful conversation with community leaders to examine these issues from multiple perspectives. Together, the panel will explore how immigration and immigration policy influence regional economic growth, workforce development, cross-border commerce, public services, and community well-being. The discussion will consider both the opportunities and the challenges immigration presents for employers, policymakers, and the broader San Diego economy, while also examining the ethical considerations that inform business and public policy decisions. Rather than advocating for a single viewpoint, this program is designed to foster informed, respectful dialogue and deepen public understanding of one of the defining issues of our time. Through a balanced exchange of ideas, panelists will explore practical approaches to strengthening our region while recognizing the diverse perspectives that shape this complex conversation. Join us for an engaging discussion that reflects the spirit of the Engage San Diego series—bringing together diverse voices to tackle difficult topics through civil discourse, informed analysis, and constructive community engagement. What We’ll Explore Immigration and the Regional Economy How does immigration influence San Diego's workforce, economic growth, business competitiveness, and cross-border prosperity? Ethics, Policy, and Public Responsibility How can communities balance economic needs, humanitarian values, public safety, and the rule of law in shaping immigration policy? The Business and Government Perspective What roles do employers, local government, and community leaders play in addressing workforce challenges and creating opportunities for shared prosperity? The Future of Our Region As immigration policy continues to evolve, what practical solutions can help strengthen our economy, support our communities, and ensure the long-term success of the San Diego–Baja California region?

Business Restructuring Review Vol. 25 No. 4 July-August 2026

In This Issue New York Bankruptcy Court: Premature Allegations of Creditor Mistreatment Insufficient to Deny Chapter 15 Recognition of Foreign Restructuring Proceeding In In re ARD Finance, S.A., No. 25-12794 (MG), 2026 WL 817458 (Bankr. S.D.N.Y. Mar. 25, 2026), the U.S. Bankruptcy Court for the Southern District of New York was presented with a petition seeking chapter 15 recognition of Luxembourg's recently enacted bankruptcy law governing judicial reorganization proceedings. The court granted the petition, turning aside challenges to recognition voiced by a creditor group arguing that recognition should be denied based upon allegations of unfairness to creditors in the Luxembourg proceeding that would make recognition manifestly contrary to U.S. public policy. According to the bankruptcy court, recognition was warranted because: (i) the rules and procedures governing the proceeding under Luxembourg law were fundamentally fair; (ii) the petition otherwise satisfied chapter 15's recognition requirements; and (iii) the creditor group's allegations were premature, given the fact that the Luxembourg court presiding over the debtor's restructuring proceeding had not confirmed a restructuring plan, and all creditors had the right to participate fully and voice their objections in the proceeding (including the right to appeal an order approving a plan). Apr. 6, 2026), the U.S. Bankruptcy Court for the Southern District of Florida granted in part and denied in part post-recognition motions filed by an insider of a foreign debtor seeking to bar or limit discovery sought by the debtor's foreign representative concerning allegedly voidable transfers involving the debtors' U.S. real property. According to the court: (i) although chapter 15 includes its own discovery provisions among the relief that may be granted to a foreign representative, the expansive discovery available in cases under other chapters of the Bankruptcy Code is also available in chapter 15 cases; (ii) the discovery sought by the foreign representative was permissible; (iii) discovery regarding matters that were the subject of a pending adversary proceeding had to be undertaken under the more restrictive rules applicable to such proceedings; and (iv) a discovery request would be barred to the extent that it sought production of documents or testimony from a subpoenaed entity that exceeded the geographic limitations specified in such rules. (In re Credito Real S.A.B. de C.V. SOFOM, E.N.R.), 677 B.R. 192 (D. Del. 2026), appeal filed, No. 26-2356 (3d Cir. June 5, 2026), the U.S. District Court for the District of Delaware affirmed a bankruptcy court order granting chapter 15 recognition to a Mexican "concurso mercantile" proceeding and enforcing nonconsensual third-party releases approved by the Mexican court. Agreeing with the bankruptcy court that the releases were not manifestly contrary to U.S. public policy, the district court concluded: "It is well settled that U.S. bankruptcy courts can give effect to foreign orders in recognized foreign proceedings pursuant to the authority granted in Chapter 15, even when those orders contain relief unavailable under U.S. law. [The appellant's] arguments misconstrue the Supreme Court's narrow holding in Purdue, applicable in Chapter 11 cases, as well as the statutory framework of Chapter 15 and its core policy objectives. Accordingly, I will affirm the Enforcement Order." The ruling has been appealed to the U.S. Court of Appeals for the Third Circuit. [read more …] Fifth Circuit: Bankruptcy Court, Not State Court, Had Jurisdiction to Allow or Disallow Administrative Expense Claim In Storey Minerals Ltd. v. EP Energy E&P Co., LP (Matter of EP Energy E&P Co., LP), 169 F.4th 609 (5th Cir. 2026), the U.S. Court of Appeals for the Fifth Circuit affirmed lower courts' rulings disallowing a creditor's administrative expense claim. It also rejected the creditor's argument that, because the claims were predicated on state law, a state court should adjudicate the merits of the state law causes of action before the bankruptcy court could allow or disallow the claim as an administrative expense. According to the Fifth Circuit, even though the causes of action were based on state law, the bankruptcy court had jurisdiction to determine whether the creditor's claims should be conferred with administrative expense priority in the debtors' chapter 11 case. Ltd., No. 25-10745 (PB), 2026 WL 592250 (Bankr. S.D.N.Y. Mar. 3. 2026), the U.S. Bankruptcy Court for the Southern District of New York considered the bona fides of an involuntary chapter 11 petition filed by certain holders of U.S. dollar-denominated notes against a holding company for a group of Chinese property development companies that filed a restructuring proceeding in the Cayman Islands after the noteholders filed the involuntary chapter 11 petition. The court denied the debtor's motion to dismiss the chapter 11 case. Given the timing of the filing of the Cayman Islands restructuring proceeding, the absence of any progress in the proceeding for seven months, the debtor's need to restructure notes governed by U.S. law, and the debtor's lack of any meaningful contacts to the Cayman Islands, dismissal of the chapter 11 case was unwarranted under the applicable provision of the Bankruptcy Code, international comity, or the doctrine of forum non conveniens. Union, No. 24-70277-JAD, 2026 WL 560452 (Bankr. W.D. Pa. Feb. 27, 2026), a chapter 7 trustee sought court approval to sell certain avoidance actions to a creditor of the debtor's estate. Potential targets of the subject avoidance actions objected, arguing that such claims were nontransferable powers of the trustee rather than saleable estate property and urging the court to approve their competing settlement with the trustee. The U.S. Bankruptcy Court for the Western District of Pennsylvania disagreed with the potential defendants, holding that they lacked standing to object to the proposed sale, that avoidance actions are indeed estate property, and that the sale—rather than the settlement—best served the estate's interests. Buddy Ayers Construction Inc., No. 25-6, 2026 WL 1686028 (U.S. June 11, 2026), the U.S. Supreme Court overturned a Fifth Circuit decision judicially estopping a chapter 13 debtor from asserting a personal injury claim against a construction company because the debtor failed to disclose the claim during his bankruptcy case. In so ruling, the Court held that "[t]he Fifth Circuit erred by artificially narrowing its inquiry to whether the debtor had knowledge of the underlying facts or a potential motive to conceal the claim." It represents the first time that the Court has applied judicial estoppel in the bankruptcy context, although it has suggested in other contexts that it may be inappropriate where an inconsistent legal position resulted from "inadvertence or mistake." Also in June, the Court denied petitions for certiorari in a few notable bankruptcy cases. The article discussed U.S. Bankruptcy Judge Christopher Lopez's July 7, 2026, ruling that participating lenders in Serta Simmons Bedding's 2020 non-pro rata uptier exchange breached the credit agreement's ratable-sharing provision, and awarding excluded lenders more than $261 million in damages. The opinion resolves six years of litigation related to Serta's 2020 transaction, where it raised $200 million in new financing and exchanged $1.2 billion of term loans for $875 million in superpriority debt. Judge Lopez found that the debt-for-debt exchange constituted a "payment" under the credit agreement, requiring proportional sharing among lenders, and dismissed various defenses raised by the participating lenders.
