Bobby Kotick’s lawyers sent me a bad email (and later apologized)
The message I had received was unsettling—for a moment. Then it was just really confusing. Back on January 20 of this year, at 5:15pm ET, I received an email with the subject line “Legal Correspondence re Bobby Kotick.” It was from the law firm Clare Locke, a firm I’d heard had been emailing reporters in recent years about their coverage of Kotick, the former, longtime CEO of Activision Blizzard. The letter was threatening. A lawyer from the firm introduced themselves as “defamation counsel to Bobby Kotick.” They issued a “demand” that I “correct” a Game File article I’d published a week prior. The article that had irked them had been a scoop of sorts. I’d written about a a 2022 lawsuit brought by a Swedish pension fund, AP7, over Microsoft’s purchase of Activision Blizzard. The suit wasn’t news, but I was first to review and report about Kotick’s extensive pushback to the fund’s claims. The pension fund’s core contention was that the sale had been rushed by Kotick to avoid the consequences of sexual misconduct scandals swirling around the company in 2021. (He’d not been accused of misconduct himself in those suits, to be clear.) As I wrote at the time, Kotick had denied the allegations of the rushed sale. Beyond that, Kotick used a December 2025 reply to the Swedish fund’s lawsuit to assign blame for those workplace scandals, the bad press and even for the AP7 lawsuit. I’d found Kotick’s arguments novel and newsworthy. Across nearly 3,000 words, I explained Kotick’s take: that a Swedish gaming company was behind the Swedish fund’s lawsuit (the Embracer group; they denied it); that the Microsoft-Activision deal was not rushed and was secured at what Kotick felt history had proven to be an optimal price for shareholders; that he believed a conspiracy of people at unions government agencies, PR firms and the media had spun up claims of widespread workplace misconduct at Activision Blizzard in 2021. The article gave context for all of this, letting readers assess the claims and weigh their credibility. As I’d later write to Kotick’s lawyers: I would be surprised if you could point to any news article about Bobby Kotick in the last five years that has spent more of its wordcount articulating his point of view. He is welcome to do an interview with Game File any time. Nonetheless, there they were in my inbox that Tuesday evening: Clare Locke, the law firm that secured a $787.5 million settlement from Fox News over false statements about voting machines. They were emailing me, threatening that failure to comply with their demand could support a claim of “actual malice,” a legal standard for libel. Unless… Unless, they said, I added a key paragraph to my article. This was a paragraph that I already knew Kotick’s lawyers had been emailing reporters about for at least a year, and it was a paragraph that was already in my article. The paragraph they wanted is from a 2023 settlement that California’s Civil Rights Department struck with Activision Blizzard. The settlement had closed a two-year-old lawsuit over alleged sexual discrimination at the game maker. The paragraph basically said that claims of systemic or widespread sexual harassment—or of execs like Kotick tolerating such behavior—had never been proven. I’d already seen proof that Kotick’s lawyers had pushed for the settlement’s language to be added to reports about 2021 sexual discrimination and misconduct lawsuits brought against Activision Blizzard by California and, separately, by the U.S. federal government (both suits were since settled). I knew that Kotick and his lawyers felt that the California settlement language should be mentioned in the same breath as references to an article he hated and denied, a November 2021 Wall Street Journal article claiming Kotick knew “for years” of sexual misconduct at Activision Blizzard. So, in the Game File article that Clare Locke emailed me about, in the interest of ensuring I was being fair and balanced regarding the person I was covering, I had already included the following excerpt from the California settlement [emphasis added in bold]: (Kotick has repeatedly pushed back against that November article in the Wall Street Journal, citing among other things, language from a court-approved consent decree as part of Activision’s 2023 $54 million settlement over the California suit. It states: “no court or any independent investigation has substantiated any allegations that: there has been systemic or widespread sexual harassment at Activision Blizzard [or] that Activision Blizzard senior executives ignored, condoned, or tolerated a culture of systemic harassment, retaliation, or discrimination.”) On the evening of January 20, I was incredulous. How do you write a four page legal threat about a week-old article and miss this? While scrambling to also make my kids dinner, I wrote a lengthy reply to Clare Locke’s lawyers, basically asking them to cool it with the threats and to start making sense. In part, I wrote: I hope you can understand why I am having trouble understanding what you’re asking for, when the statement you’re demanding to see in Game File’s article already appears in Game File’s article. Actual malice, as you know, refers to a reckless disregard for the truth. I’m not sure what your argument is when my article already states your client’s position. Here is where I should remind you, the reader, that I am an independent journalist. I publish on Substack, and have availed myself of the Substack Defender program that provides writers on the platform with legal support. But I’m no Wall Street Journal or New York Times, nor even IGN or GameSpot when it comes to such things as, well, having a legal department. There are more fun things for me to do as an independent journalist than writing back to a powerful law firm representing a very rich person. On the evening of January 20th, I was just trying to cook some pasta, broccoli and chicken nuggets for hungry twins. Nevertheless, I wrote back to them. Two hours later, I got a reply. Summarizing: A lawyer for Clare Locke said they’d “reviewed an incomplete version” of my article and they “apologize for the confusion.” (My guess: Someone didn’t read past the piece’s paywall, even though they’d had a full week to scrounge up the funds to do so. What I’d published above the paywall was balanced, as was what came after.)1 That was almost that, but something about the situation bothered me. The letter had been marked “confidential.” I hadn’t agreed to that, and I disliked the idea that powerful people on the beat that I cover would act like they could unilaterally control what I might tell my readers about. On the morning of the 21st, having already gotten the powerful law firm to back off, I oh-so-wisely re-approached them with just one more thing. I thanked them for clearing things up the night before but noted that I’d never agreed to keep their letter confidential. I’m all for agreeing with a source to keep things off the record, but that’s the thing. We have to agree. You can’t just declare it. I’m not bound by that. I wrote to Clare Locke’s lawyer and said, in part: I trust the matter is resolved. It was disappointing to have to spend less time with my kids last night in order to address your legal letter. Family time’s precious. I will add, for clarity’s sake, that, while your letter stipulated that it was confidential, I did not agree to those terms. In the future, should you wish to communicate with me confidentially, I am happy to agree to classifying our communication as “off the record” prior to the actual communication—as is standard with any professional journalist. The firm’s lawyer replied, not directly addressing the confidentiality issue but asserting that the matter was resolved. Why I didn’t write about this until now In May, I told this story on an episode of Simon Parkin’s podcast My Perfect Console, but I held off on sharing it directly with Game File readers. I held off to avoid stepping on the toes of another reporter, the journalist Mikhail Klimentov. He’d interviewed me in the spring of 2025 about an investigation he was working on regarding Bobby Kotick lawyers pressing the media to add the California settlement language to stories referencing the 2021 lawsuits. And about how some outlets had changed their stories and how some simply deleted them. Initially, I was a third-party source for Klimentov’s reporting, providing on-the-record context about the state of the games media. I’d heard about the letters but hadn’t put the time into pursuing the story. I thought it was interesting, and I was glad he was covering it. When the outlet that Klimentov was going to run his reporting in dropped the story, I began talking to him about potentially publishing his reporting on Game File. This was tentative. Then, in January, when I got my own Clare Locke letter, I told Klimentov that I didn’t think it would make sense for me to publish him, not with me now being part of the story. I had my own version of this situation to tell. But I wished him well and said I’d refrain from telling my tale until he could get his reporting out there. Last Friday, Klimentov finally ran his investigation, in a nearly 48-minute video report for People Make Games. It covers various Clare Locke letters, how media outlets reacted to them and what to make of all this. His video weighs the merits of Kotick’s request and looks at some of the articles that were changed (one of which had a glaring error). I highly recommend watching it: (Note, I did some editorial consulting for a People Make Games video last year but nothing to do with this report.) While many outlets haven’t left any public evidence that they updated their Kotick coverage at Kotick’s counsel’s request, at least one has. Back in October 2025, the mainstream outlet Reuters applied the most transparent article update I’ve seen. On the 3rd of the month, they published an article about the state of the Swedish pension fund’s lawsuit. Days later, they added this: In an October 7 letter sent after publication of this article, Kotick’s defamation counsel disputed claims of widespread harassment at Activision. “Not a single investigation, court finding, verdict, or ruling ever concluded that there was any merit” to the allegations of widespread harassment at Activision, Tom Clare and Nick Brechbill of Clare Locke wrote. I’ve never added a statement to my article on Game File, because none was needed. Not for fairness’ sake, nor to meet any demands of Kotick’s lawyers. I’ve nevertheless wanted to be transparent with Game File readers. If someone powerful is questioning my reporting, is threatening a lawsuit over it… if that threat is part of a pattern involving other games media outlets and if, in my case, the whole thing ran into a ridiculous ditch, I want you to know about it. I also share this as a real example of how I handle threats to Game File. I stand up for my own reporting, even when it’s not comfortable to do so. (In that same category of standing up for the work I do, I’ll point to an incident in late August. Asocial media post I published to X/Twitter regarding reporting I did about Take Two and GTA VI was hit by bogus copyright claim by a firm working for the publisher. I pushed back and got it reversed; even while a bigger games media outlet let themselves be censored. This is the other reason I’m sharing this story: To emphasize that dealing with threats from powerful people is one of the costs of covering the video game industry independently and as fearlessly as possible. This is where you come in. Your support, through free and paid subscriptions (sign up here!), can help me keep doing that. It can ensure that I’ve got the back-up I need. And it can help make fiascoes like this even less of a worry, so I can spend my evenings dealing with more important things, such as making sure I steam the kids’ broccoli just right. 1 That pension fund lawsuit I wrote about in January has all but gone away. In May, the fund and Activision Blizzard owner Microsoft agreed to settle. Lawyers for the fund brokered a $250 million settlement for former Activision Blizzard shareholders. In the settlement, the fund’s lawyers changed their rhetoric. Where once they’d questioned the meaning of the California settlement language, they adopted a version of it for themselves. Several weeks ago, while seeking to get a court to sign off on the terms of the settlement, they proposed their fee for their work in the case: $60 million.

A deep dive into climate change
Some policymakers continue to question the science of climate change, despite the growing evidence of significant damage to life on land and in the ocean.Katja Matthes, director of the GEOMAR Helmholtz Centre for Ocean Research Kiel in Germany, believes the ongoing attempts to politicise climate science and discredit researchers are hindering international cooperation and public understanding. The ocean provides clear evidence of the extent to which changes are occurring, she says.“We are seeing severe, unprecedented and accelerating changes in the ocean — warming ocean temperatures, acidification and oxygen depletion — that are destabilising the most important system that makes life on this planet possible,” Matthes explains. Visible signs of these changes include the melting of ice sheets in the Arctic and Greenland. Deeper down, the growing frequency of hypoxia — or oxygen-deprived “dead zones”, where marine life can no longer survive — in the Baltic and record-high Mediterranean surface temperatures are indicators of the “dramatic warming” of the ocean, she adds. The ocean, which covers around 70% of the Earth’s surface, acts as a vital carbon sink, absorbing around 30% of the planet’s carbon dioxide (CO2) and 90% of the excess heat. However, the global ocean surface temperature has risen by an average of half a degree Celsius since 1982, according to the EU Copernicus observatory. More significant rises have been recorded in the Mediterranean, Black, Baltic and other shallower seas. Some ocean temperature increases do occur naturally, such as during El Niño events. But sustained rises can trigger extreme weather on land — including droughts, floods and catastrophic storms — while also harming marine ecosystems. Only 10% of marine species have been studied, Matthes notes, “so the consequences might be even more severe than we know.”Fostering European cooperation amid uncertaintyMatthes, who holds a doctorate in meteorology, is a professor of atmospheric physics as well as director of GEOMAR. She serves as one of Kiel’s ambassadors to Science Comes to Town (SCTT), an EU-funded programme that aims to promote science’s role in society and strengthen cross-border collaboration in research, innovation and sustainability. SCTT is hosted by the coastal cities of Kiel, Brest (in France) and Split (in Croatia). The SCTT project also provides a platform for raising awareness and understanding between scientists and the public about major issues, such as climate change. Having worked on both sides of the Atlantic, Matthes is frustrated by recent attempts to erode decades of international climate collaboration and question the credibility of research. Earlier this year, the US administration delivered a major blow to global cooperation by withdrawing from the Intergovernmental Panel on Climate Change (IPCC), the UN Framework Convention on Climate Change and other global climate organisations, claiming they were “contrary to the interests of the United States.”In addition, a US Department of Energy (DOE) report cast doubt on the latest IPCC climate assessment, which was published in 2024. As a contributing author to the IPCC study, Matthes says the DOE sought to discredit scientists like herself. “Climate change is not a matter of opinion, it really exists and we are witnessing dramatic changes,” she notes. “It’s not climate change as a whole that is being targeted, but scientists and their research.”Other US actions have also hit home for Matthes, who spent three years at the US National Center for Atmospheric Research (NCAR) in Boulder, Colorado. The White House has announced plans to close the facility, a move that was “pretty tough” due to the German scientist’s personal connections with the staff and their reputation for excellence.Changing the narrative on climate changeEurope’s scientific community remains a driving force on climate research and collaboration. As one of the world’s leading marine research institutions, GEOMAR attracts students from more than 50 countries and plays an important role in global observation initiatives that contribute to understanding and protecting the ocean basins. GEOMAR has also developed innovative and safe strategies for removing unexploded wartime munitions from the seabed, which release toxic substances that pose a danger to humans and the marine environment. Through the Horizon Europe MMinE-SwEEPER project, this knowledge has been transferred to the European level. These initiatives are examples of how local action can have a global impact, Matthes says, and how Europe can strengthen climate research and partnerships. “This is a chance for Europe to step up and work on climate cooperation and agreements,” she notes. “Climate change is an international problem and a real threat, and we need more speed on climate action than we have now.”Matthes believes her fellow scientists need to communicate that climate change is not only a threat, but an opportunity to find solutions. “We need to change our narrative and expand our strategic alliances with those who are willing,” she says, “and luckily there are a lot of willing people and countries.”Science|Business, which connects policymakers, academics and industry through its news reporting, analysis and events, is an SCTT partner.

The Politics of Sustainability Have Changed. The Business Case Hasn’t.
Corporate sustainability may have fallen out of favor in some executive and political circles, but the business case remains strong: Companies continue to invest because sustainability initiatives can deliver measurable gains in profitability, resilience, and growth. Drawing on research from NYU Stern’s Center for Sustainable Business and other recent studies, the article shows how four areas in particular—circularity, decarbonization, sustainable sourcing, and employee well-being—can lower costs, reduce risk, strengthen supply chains, improve productivity, and create new revenue opportunities. Examples from industries including automotive, healthcare, apparel, energy, consumer goods, and manufacturing illustrate how companies are capturing value through resource reuse, energy efficiency, resilient sourcing strategies, and investments in frontline workers. While the language of ESG may be losing momentum, the underlying business fundamentals have not changed: organizations that systematically address material environmental and social challenges, quantify the financial impact of their efforts, and embed sustainability into core decision-making are better positioned to improve operational performance and create long-term enterprise value.

Make the Business Case for Your Sustainability Initiative
Sustainability proposals often stall not because they lack merit, but because they are framed in a language that does not match how senior leaders allocate capital. While CSOs tend to emphasize impact, materiality, and disclosure, CFOs and CEOs need to understand cash flow, risk, and return. External reporting frameworks are useful for accountability, but they are poorly suited to internal investment decisions, which require project-level comparisons rather than aggregated enterprise metrics. Sustainability investments should therefore be evaluated like any other investment: by showing how they reduce current costs, avoid future costs, generate new revenue, or protect existing revenue. Strong cases begin with a clear business story that links the proposed action to a specific business impact and cash-flow outcome, then quantify what can credibly be quantified while treating harder-to-measure benefits as either upside or an explicit strategic bet.

When regulation is good for business
By now, I think I have established both my view that I am a fan of ESG investing and the benefits of regulating what is and isn’t a sustainable investment, and my view that in Europe, ESG regulation has gone too far and become too costly. It almost feels like the old Aristotelian maxim of doing things in moderation that leads to the best outcomes is valid in regulatory efforts as well. To give you an example, let’s look at a study by the National Bank of Belgium on the impact of the EU’s Sustainable Finance Disclosure Regulation (SFDR) on fund flows of conventional and ESG funds. The SFDR was announced on 27 November 2019 and came into effect on 10 March 2021. It was implemented in several stages and split funds marketed in the EU into three broad categories: (i) Art. 6 funds that are basically conventional funds without any specific ESG integration, (ii) Art. 8 funds that ‘promote environmental or social characteristics’, which must provide additional reporting how they do that, and (iii) Art. 9 funds that are impact funds. The gaps between the announcement and the phased implementation give us an idea of how fund flows were affected by the regulation. It is clearly visible in the figure below that once the new regulation was announced and when it was initially implemented, fund flows in Art. 8 and Art. 9 funds increased significantly. Conventional Art. 6 funds also saw more inflows, but the increase was not statistically significant. I should add that the data below is pure fund flow, cleaned of performance effects and of any reclassified funds that moved from one classification to another. Note also that once the initial rush in ESG funds was over, additional, stricter regulatory requirements didn’t create that many new flows. This implies that with additional regulation, the funds incurred higher costs to comply but didn’t benefit in terms of new inflows and higher assets under management. Fund flows as the SFDR regulation was implemented in the EU Source: Emiris et al. (2026) When examining the drivers of these flows, the authors of the study found that institutional investors were more likely to switch to ESG funds and particularly so in countries where concerns about sustainability are culturally more accepted. In a society where buy-in into environmental and social risks is higher, private investors were shifting more of their assets into ESG funds as the regulation made it clear which funds are really green and which ones are not. And institutional investors in these countries did so as well, given the societal pressures and reputational risks of sticking with conventional funds. Meanwhile, fund managers reacted to the changing regulatory environment as well. Many funds that were mildly green before the regulation was announced became greener and more sustainable as the regulation was introduced to attract new assets and new investors. Cleverly, and unsurprisingly, these ESG funds also charge on average higher fees, which means that not only did fund managers gather fresh assets, but their profitability increased as well.

Please Stop Conflating Sports Betting Handle With Spending On Entertainment
Editor’s note: The Cashout for paid subscribers will publish on Tuesday. Every September there’s a huge uptick in how much people bet on sports with the start of football season. Which means it’s time to get ahead of a ridiculous narrative before it picks up steam on social media or in mainstream media. Subscribe Every few months I see some version of this: [ Charlie Bilello@charliebilello Americans bet over $165 billion on sports last year, which is more than they spent on movies, books, concerts and sports tickets - combined. 1:00 PM · Jun 28, 2026 · 4.1M Views 258 Replies · 674 Reposts · 4.23K Likes ](https://x.com/charliebilello/status/2071217050328895935?s=20) Fortune published this in July. The headline and start of the story tell the same narrative (emphasis added): Gambling becomes America’s favorite pastime as Americans spend more on sports bets than movies, arts, museums, and music combined: The North American box office totaled $8.87 billion in 2025, which is still 22% below pre-pandemic levels. Recorded music revenue hit a record $11.5 billion. Live music like concerts and festivals brought in $18.51 billion. Meanwhile, book publishers tracked by the Association of American Publishers reported $14.6 billion for the year. And the U.S. museum industry generated an estimated $16.4 billion. Add it up and the total comes to roughly $70 billion, which is less than half what Americans wagered on sports. The story, to its credit, goes on to tell us why sports betting is entirely different, although people who only read headlines will miss that nuance. (The tweet above definitely skips over the nuance.) I will mostly be preaching to the choir here, but it’s worth saying out loud: Wagering money on sports is not the same thing as spending on entertainment from a financial perspective. When you spend money on a movie or concert ticket, that money is gone. You exchanged money for an experience. It’s a good trade! I get to have fun for “x” dollars. (Unless the movie sucks, I guess.) When you bet money on sports, the money is not necessarily gone every time you wager it. It could be gone, but sometimes it’s not and you actually get more money back! That’s not “spending” money or something you should try to compare directly to entertainment spend. A far better comp would be how much people lose at sports betting. That number was more like $17 billion in the US last year, at least for state-regulated sportsbooks. Why are we trying to equate handle and entertainment spending? I dunno. It makes for splashy headlines, I guess. Now, people should be betting for entertainment, and not because they expect to win in the long term; no doubt about it. Anyway, here’s hoping I don’t see people saying Americans “spent” hundreds of millions of dollars on sports betting this fall.
